Good question. I think it could be argued that everyone will show glimpses of the fruit of the Spirit, but perhaps these aren’t consistently prevalent in their lifestyle, which seems to be the point of them being characterized as fruit; they reproduce themselves consistently. Either way, I think Paul’s definition of life if the Spirit is contrasted with the life in the flesh and both are contextually, living by God’s grace versus living by our works. Maybe some non-believers tap into the realm of the Spirit more than we realize? That could also be why Paul says that if we are going to live there we should walk there. Some seem to live there (partake), but don’t walk.
